JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner being director of the Nursing Home, took Rs.50,000/- for making available blood, oxygen, and medicines to the the informant's daughter at the time of Cesarean child birth, but he did not do so and informant's daughter died ultimately.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Payment of Rs.30,000/- was made to co-accused Rajesh Paswan and not to the petitioner. No cheat of paper has been collected during investigation to support the allegation that the

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge X, Vaishali at Hajipur in Lalganj Police Station Case No. 317 of 2020.
