Heard learned counsel for the petitioner, counsel for the informant and the State.

The petitioner seeks bail in Bathnaha P.S. Case No. 202 of 2018, instituted for the offence under Section(s) 302/34 of the Indian Penal Code.

It is alleged in the written report that informant got information by his younger son that dead body of brother of the informant is lying in bamboo-clumps. It is further alleged that deceased had some land dispute with this petitioner as he had refused to execute sale deed, for which, the petitioner had given threat.

Patna High Court CR. MISC. No.20583 of 2019(2) dt.03-04-2019 2/2 Counsel for the petitioner submits that besides suspicion, there is no allegation of any specific overt act against the petitioner. He further submits that co-accused Guddu Singh has already been granted bail by coordinate Bench of this Court vide order dated 18.12.2018 passed in Cr. Misc. 68588 of 2018.

Petitioner is in custody since 18.1.2019 having clean antecedent.

Counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S.
