JUSTICE BIRENDRA KUMAR ORAL ORDER 19-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Ahiyapur P.S. Case No.621 of 2017, a case under Section 364A of the Indian Penal Code.

The F.I.R. relates to kidnapping of the son of the informant. On recovery, the victim stated that his neighbour Kamlesh had induced him to go with him and thereafter he took him to the house of Sushil, where the victim was kept in captivity. The petitioner was also there. There was demand of ransom. Submission is that the petitioner has got no criminal antecedent and false case has been cooked up just to harass the petitioner.

Patna High Court Cr.Misc. No.59431 of 2017 (3) dt.19-02-2018 P2/ Considering the recovery of the petitioner as well as non payment of ransom, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
