The petitioners are languishing in custody in connection with Sahebganj (Muzaffarpur) P.S. Case No. 69 of 2015 for the offence instituted under Section 302/34 of the Indian Penal Code. The allegation against the petitioners, who are Devar and Gotni of the decease, is of committing murder of the deceased by throttling.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 01.04.2016. The charge sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner no.1 is
Patna High Court Cr.Misc. No.30686 of 2016 (3) dt.08-09-2016 2/2 Devar of the deceased and the petitioner no.2 is Gotni of the deceased. They are separate in mess and property from the husband of the deceased. The other co-accused have been granted bail vide Annexure-4 to the present application. On behalf of the state it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate (West), Muzaffarpur, in connection with Sahebganj (Muzaffarpur) P.S. Case No. 69 of 2015 corresponding to G.R. No. 621 of 2015.
