The petitioner seeks regular bail in connection with Cheria Bariyarpur P.S. Case No. 101 of 2017 instituted for the offences under Section 414 of the Indian Penal Code, Sections 30(A) and 37(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b), a and 26/35 of the Arms Act. The allegation against the petitioner is that upon the Police apprehending his motorcycle and upon a search having been made, one country made loaded pistol with two live cartridges along with 375 ml. of illicit liquor was recovered. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent and he is

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Session Judge, Begusarai in connection with Cheria Bariyarpur P.S. Case No. 101 of 2017.
