JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-06-2020 Heard Dr. Bipin Chandra, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned counsel appearing for the State through video conferencing. The petitioner seeks regular bail in connection with Maniyari P.S. Case No. 51 of 2019 bearing G.R. No. 673 of 2019 registered for the offence punishable under Section 414 of the Indian Penal Code, 1860 and Section 25 (1-b)a / 26 / 35 of the Arms Act.

The allegation against the petitioner is that the Police intercepted a motorcycle and searched the persons sitting on the motorcycle including the petitioner and from the possession of the petitioner Police seized one live cartridge and a mobile phone and from the possession of other accused persons namely, Abhishek Kumar one loaded country made pistol and a cartridge and from the possession of Vikash Kumar one live cartridge and a mobile phone were recovered.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.18619 of 2020(2) dt.04-06-2020 2/2 co-accused Abhishek Kumar has been granted bail by this Court in Cr. Misc. No. 43070 of 2019 and Vikash Kumar has been granted bail in Cr. Misc. No. 45756 of 2019. Learned counsel further submits that petitioner has got no criminal antecedent and he is in custody since 07.03.2019.

Having regard to the submissions made by the parties and taking into consideration the fact that similarly situated accused persons have been granted bail by this Court and the petitioner is in custody since 07.03.2019, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Maniyari P.S. Case No. 51 of 2019 bearing G.R. No. 673 of 2019.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
