1. The short prayer made by the petitioner in the present case is to direct the Circle Officer-Tetariya, District-East Champaran at Motihari, to conclude the proceedings of the pending Encroachment Case No.4 of 2022-23.

2. Per contra, the learned counsel for the respondentState has submitted that in case the aforesaid encroachment proceeding has yet not been concluded, the same would definitely be concluded within a fixed time frame.

3. Having regard to the facts and circumstances of the

Patna High Court CWJC No.5038 of 2023(2) dt.16-10-2023 2/2 case, I deem it fit and proper to direct the Circle OfficerTetariya, District-East Champaran at Motihari, to conclude the aforesaid encroachment proceedings, in case the same have not already been concluded, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of six weeks of receipt/production of a copy of this order.

4. The present writ petition stands disposed off on the aforesaid terms.
