2. The petitioner seeks bail in connection with Gogari P.S. Case No. 134 of 2023 registered for the offence under Sections 304B/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.

3. As per the prosecution case, the marriage of the deceased was solemnized with the petitioner in the year 2018 and he is alleged to have killed the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and no material has come during against the petitioner with the crime. He further submits that during investigation it has come that the deceased has committed suicide over a small dispute with the petitioner.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail after framing of charge if the charge has not already been framed on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case No. 134 of 2023.

7. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
