JUSTICE SUDHIR SINGH ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. Allegation is that the accused persons including the petitioner have killed the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.8.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The witnesses in paragraphs 9, 10 and 23 of the case diary have stated that the deceased had caught fire. Thereafter she was taken for treatment, but she
Patna High Court Cr.Misc. No.33367 of 2016 (4) dt.28-10-2016 2/2 succumbed to the burn injuries sustained by her. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Araria in connection with Sessions Trial No.283 of 2016 arising out of Forbesganj P.S. case No.366 of 2015.
