Petitioner seeks bail in connection Ahiyapur P.S. Case no. 906 of 2020 registered for the offence punishable under sections 20 and 22 of the NDPS Act.

Learned counsel for the petitioner submits that petitioner is person with clean antecedent and is in custody since 02.12.2020 and charge sheet has been submitted. Learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the FIR, it would manifest that though the informant alleges that ganja was recovered but has not disclosed quantity of ganja but from perusal of the seizure list, it would manifest that 250 gram ganja was recovered.

Patna High Court CR. MISC. No.29911 of 2021(2) dt.24-11-2021 2/2 Learned APP vehemently opposed the prayer for bail. Considering the facts that 250 gram ganja was recovered from the house of the petitioner which is less than commercial quantity and petitioner is a person with clean antecedent and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum- Special Judge, Muzaffarpur in Ahiyapur P.S.
