The petitioner apprehends his arrest in a criminal prosecution registered under Sections 302, 307 and some other allied offences under the Indian Penal Code as also under Section 27 of the Arms Act.

Taking into consideration the fact that the petitioner is alleged to be one of the assailants of the deceased and further taking into consideration the fact that he is accused in one more criminal case, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for grant of anticipatory bail in connection with Basnahi P.S.Case No. 89 of 2013 pending in the court of learned Chief Judicial Magistrate, Saharsa is rejected. The petitioner, if so advised, may surrender before the court below within a period of four weeks from today and pray for regular bail. If such a petition is filed, the same shall be considered on its own merit without being prejudiced by the present order. (Birendra Prasad Verma, J) Tahir/- U T
