The petitioner has been arrested in Kadam Kuan P.S. Case No. 398 of 2017, Special Case No. 131 of 2017, instituted for the offence under Sections 20 and 22 of the N.D.P.S. Act. The earlier application for bail (Cr. Misc. No. 47016/2017) was withdrawn on 22.9.2017. There is no previous history of such crime being committed by the petitioner. He is in jail since 5.9.2017. The investigation has been completed and charge sheet has been filed.

Looking to the totality of the circumstances and quantity of psychotropic substance seized, the application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 5,000/- ( Rupees five thousand) with
