ANJANA MISHRA ORAL ORDER 15-12-2015 Heard learned Counsel for the petitioner and learned Counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with K. Hat (Sahayak) P.S. Case No. 271 of 2015, registered for the offences punishable under sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act. Learned Counsel for the petitioner submits that though the petitioner named in the First Information Report, there is no specific allegation against him. Petitioner's name has been surfaced only on the basis of certain malicious elements which were inimical to the petitioner. He further submits that another similarly situated person, namely, Binay Sah has been extended the privilege of anticipatory bail in Cr. Misc. No. 29258 of 2015 vide order dated 06.10.2015.

No.35982 of 2015 (4) dt.15-12-2015 Considering the aforementioned facts and circumstances and also that the petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount, each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Sahayak) P.S. Case No. 271 of 2015,, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
