This application is for grant of regular bail in connection with Biraul P.S.Case No.189 of 2015 for the offences punishable under Sections G.R.No.504 of 2015 of the Indian Penal Code.

There is direct allegation against the petitioner of firing on the deceased, which is cause of his death. Submission of the learned counsel for the petitioner is that there is no eye witness of the occurrence and due to family dispute, his name has been mentioned. The petitioner, deceased and the informant are full brothers. It has also been submitted that later on the informant filed a petition in this Court that he had not seen the occurrence, which has come in the impugned order.

Heard learned A.P.P. also.

Having heard both sides and in view of fact that there is direction allegation, I am not inclined to grant bail to the petitioner, however, since the petitioner is in custody, the learned court below is directed to expedite the commitment of the case and once the case is committed, he will try to expedite the trial and dispose of the same within a period of seven months from the date of order.

With the aforesaid observation, this application is dismissed.
