This application is filed for grant of regular bail in connection with Pipra P.S. Case No. 574 of 2021 registered under section 304(B)/120(B)/34 of the Indian Penal Code. The prosecution story in short is that the informant namely Ayodhya Paswan married his daughter to Abu Paswan. Informant gave various gift including furnitur, jewelry, utensils and cloth but after marriage, the in-laws started demanding dowry. The informant tried to satisfy their demand as per his capability. One day informant received phone call from Abu Paswan who informed that his daughter Chanda Devi has died.
Patna High Court CR. MISC. No.23939 of 2023(2) dt.17-05-2023 2/2 When informant reached their, in-laws became furious and tried to attack them. But informant had seen a mark on her daughter's neck and it appeared that she had been killed in a pre-planned manner by Abu Paswan and his family members.
Learned counsel for the petitioner submits that the petitioner is in jail since 24.11.2022 and he has been falsely implicated in this case.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody and the allegations levelled against the petitioner, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail after framing of charge in the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate-I, East Champaran in connection with Pipra P.S. Case No. 574 of 2021.
