2. The petitioners seek regular bail in a case registered for the offence under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, all the accused persons including these petitioners are said to have committed murder of the husband of the informant.

4. Learned counsel for the petitioners submits that the FIR was lodged against five suspected persons for killing the deceased. Except for suspicion, there is no material against the petitioners. Petitioners are in custody since 04.09.2024.

5. Learned counsel for the informant has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 8th Additional Chief Judicial Magistrate, East Champaran, Motihari/concerned Court below in connection with Pakridayal P.S. Case No. 220 of 2024 subject to condition that:- 7(i). The petitioners shall appear in the trial regularly either personally or through their lawyer and shall cooperate in the trial and non-cooperation in the trial will result in cancellation of the bail bonds of the petitioners.
