Petitioner, already in custody, seeks bail in connection with Aurangabad (Town) P.S. Case No.221 of 2017, registered under Sections 356 and 379 of the Indian Penal Code. Allegation in brief is that two miscreants snatched the bag of the informant while he was coming out from the bank and going to board his vehicle.
Learned counsel for the petitioner submits that except the name of the petitioner disclosed by two co-accused in their confessional statement, there is no other material, neither he was put on TIP nor any incriminating material has been recovered and one of the co-accused who disclosed the name of the petitioner, namely, Subhash Kumar has been admitted to bail by a coordinate
Patna High Court Cr.Misc. No.57579 of 2017 (3) dt.17-01-2018 2 /2 Bench of this Court by order dated 11.01.2018, passed in Cr. Misc. No.62216 of 2017.
Considering the facts and circumstances of the case, petitioner Chandra Mohan Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aurangabad (Town) P.S. Case No.221 of 2017.
