The petitioner has preferred this application for grant of regular bail in connection with a case registered under sections 414, 420, 467, 471 and 34 of the Indian Penal Code. As per the prosecution case, on the motorcycle in question being stopped for checking, it is stated that while the petitioner managed to escape, co-accused Raj Roushan was taken into custody and he could not produce any document for the said motorcycle. He disclosed that the same was a stolen property.
It is submitted by learned counsel for the petitioner that the allegations against the petitioner are false and concocted. He has been falsely implicated in the case. No incriminating article
Patna High Court CR. MISC. No.28963 of 2021(2) dt.13-08-2021 2/2 has been recovered from his possession. The only material against him is the confessional statement of a co-accused made before police. He is in custody since 27.1.2021 and has no criminal antecedent. It is further submitted by learned counsel for the petitioner that a supplementary affidavit has been filed in the case stating about the death of his mother on 8.8.2021. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 6 months, the Court directs the petitioner to be enlarged on bail in connection with Hilsa P.S. Case no. 667 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Hilsa, Nalanda.
