The petitioner seeks bail in Phulparas P.S. Case No. 272/2015, registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

The informant lodged the case against unknown for missing of his daughter, who was sleeping with the petitioner. The petitioner is the wife of the informant. During the course of investigation, the petitioner herself confessed her guilt and in pursuance of confession of the petitioner, the dead-body of the child was recovered from the ditch.

Learned counsel for the petitioner submits that her husband was torturing her to kill her daughter and that is why the petitioner lost her mental balance and killed her daughter. It appears that it was the petitioner who killed her

Patna High Court Cr.Misc. No.34333 of 2016 (3) dt.10-03-2017 2/2 daughter and threw her dead-body in a ditch and in pursuance of the confession of the petitioner; the dead-body was recovered. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
