Petitioner, already in custody, seeks bail in connection with Pasraha P.S. Case No.98 of 2017, registered under Sections 364/34 of the Indian Penal Code.

Submission is that the petitioner and the informant are co-villagers, there is no demand of ransom, the husband of the informant was not kidnapped rather it was a simple case of assault as the informant herself has stated that her husband was assaulted in her presence. The husband of the informant stated in his statement recorded under Section 164 Cr.P.C. that he himself returned back very next morning and the petitioner is in custody since 09.08.2017.
