JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 and 392 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that son of informant while going on his motorcycle for the purpose of work which he used to do, he was killed by miscreants and his bag of rupees had been taken away. It has been submitted on behalf of petitioner that he is in custody since 30.3.2015. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is not named in the F.I.R. He has been made accused on the basis of self confession made before the police. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest his implication in the present case.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Sessions Judge, Purnea , in connection with Sessions Trial no. 393 of 2015 arising out of Rupauli-Akbarpur P.S. Case no. 285 of 2014. (Sudhir Singh, J) sudip/- U T
