This is an application for bail in connection with Masrakh P.S.Case No. 239 of 2017 registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code. Allegation as per FIR is that one stolen tractor was recovered from possession of petitioner.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been implicated in this case and he is in custody for three months, having no criminal antecedent.

Heard learned APP also.

Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released

Patna High Court Cr.Misc. No.56187 of 2017 (2) dt.23-11-2017 2/2 on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Saran, Chapra, in connection with Masrakh P.S.Case No. 239 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, except showing any genuine reason, failing which his bail bond shall be cancelled.
