The present petition has been preferred for quashing of the order dated 14.1.2023 (contained in Annexure1) of the Divisional Forest officer-cum-Licensing Officer, Saharsa cancelling the license of the Garb Saw Mill under the provisions of Section 7(5) (a) of the Bihar Saw Mills (Regulation) Act, 1990 (hereinafter called 'the Act') in the circumstances set forth below.
3. A counter affidavit of respondent no.2 is on record
Patna High Court CWJC No.4931 of 2023(2) dt.11-07-2024 2/2 and as per paragraph-7, there is provision for filing appeal before the prescribed authority against the order passed by the Divisional Forest Officer-cum-Licensing Officer, Saharsa.
4. Learned counsel for the petitioner submits that he will be availing that remedy.
5. The writ petition stands disposed of granting said liberty to the petitioner.
