The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354(A), 354(B) of the Indian Penal Code and Section 8 of POSCO Act.
It is a case of making an attempt to outrage the modesty of the victim.
It is submitted by learned counsel for the petitioner that petitioner is innocent and has committee no offence in the manner as alleged. It is further submitted that only allegation levelled against the
Patna High Court CR. MISC. No.20033 of 2022(3) dt.11-10-2022 2/2 petitioner is that he caught hold the hand of the victim. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer of the petitioner for anticipatory bail and submitted that the petitioner along with other accused persons has outraged the modesty of the informant. It is also submitted that the victim also supported the prosecution version in her statement recorded under Section 164 of Cr.P.C.
Considering the above-stated facts, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
The prayer for anticipatory bail of the petitioner stands rejected.
