The petitioner seeks bail in a case instituted for the offences under Sections 7/13 (2) read with section 13(i)(D) of the Prevention of Corruption Act, 1988.
The allegation is that the petitioner was caught red handed with the bribe money of Rs.70,000/- taking from the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.5.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely

From perusal of Annexure-6 to the present application, it is evident that the petitioner had given the informant Rs.1 lac from his personal Bank account. Out of the said amount, Rs.70,000/- was being returned by the informant to him. It is further submitted that the petitioner is ready to deposit an amount of Rs.30,000/- in the court below, which shall be subject to the final disposal of the case. On behalf of the Vigilance, it is submitted that the petitioner is named in the F.I.R. and was caught red handed. Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs.
30,000/- in the court below, which shall be subject to the final disposal of the case and on doing so, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, North Bihar, Muzaffarpur, District Muzaffarpur in connection with Special Case No.22 of 2016 arising out of Vigilance P.S. case No.49 of 2016.
