JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in S.T. No.67 of 2016 arising out of Jainagar P.S. case No.37 of 2015 instituted for the offence under Sections 147, 148, 149/34, 323, 324, 307 and 302 of the Indian Penal Code and Section 27(3) of the Arms Act, pending in the court of learned 1st Additional Sessions Judge, Madhubani. Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application. This is the second attempt on behalf of the petitioner for grant of bail.
A report was called for from the Trial Court regarding the stage of the trial. The same is at Flag 'A'. It has been reported that the case is running for evidence and summons have been issued against the witnesses. If both the parties co-operate, this case is likely to be disposed of within a period of six months.
Patna High Court Cr.Misc. No.33798 of 2016 (3) dt.28-09-2016 Considering the aforesaid report, I find no merit in the present application at this stage. The present application is rejected. The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of a copy of this order as per the report submitted by the Trial Court.
The District Magistrate, Madhubani and the Superintendent of Police, Madhubani are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the time frame.
Let this order be communicated to the District Magistrate, Madhubani and the Superintendent of Police, Madhubani.
