This is an application for regular bail in connection with Amas P. S. Case no. 48 of 2017 registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.
Informant, who is the father of the victim girl, filed written complaint stating that on 23.02.2017 at 9-30 A.M. his daughter Sarifa Kumari aged about 13 years had gone to school for studying but thereafter she did not return. He came to know that one co-villager Prashuram Das had kidnapped his daughter. The victim girl was recovered and her statement has been recorded under Section 164 of the Code of Criminal Procedure before the Magistrate in which she has stated that on 22.02.2017 she had made
Patna High Court Cr.Misc. No.59188 of 2017(2) dt.16-01-2018 2/2 conversation with the accused petitioner and she wish to marry him. Thereafter, both went to Delhi, lived there for four months and returned. The medical report has been placed before this Court in which doctor has opined age of the victim girl between 17 to 19 years. No sign of recent intercourse has been found but past intercourse has not been denied. No injury on private part of the victim girl has been found. Petitioner has no criminal antecedent and he is in jail custody since 30.06.2017.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sherghati, Gaya, in connection with Amas P. S. Case No. 48 of 2017. (S. Kumar, J) sudip/- U
