JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 Heard learned counsels for the petitioner and the State. The petitioner nos. 1 and 2 being the sister and brotherin-law and petitioner no.3 being brother of the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
The basic accusation is of torture. Though it is alleged by the complainant that petitioner no.1 the sister of the husband of the complainant tried to kill her by allowing the domestic gas to leak whereas her husband petitioner no.2 assaulted the complainant with belt and petitioner no.3 the
Patna High Court Cr.Misc. No.33819 of 2015 (2) dt.26-08-2015 2/2 brother of the husband of the complainant tried to outraged modesty of the complainant.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the entire in-laws family and there is no injury report on record to suggest that the complainant was assaulted. Considering the thrust of accusation against the husband of the complainant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Nawada in connection with Complaint Case No.2008 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
