Mr Rajesh Kumar Verma, ASG ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 05-07-2019 Learned Assistant Solicitor General of India appears in the instant case on behalf of respondent-Union of India. Referring to the averments made in the pleadings on record, it is submitted that the authorities have strictly followed the procedure prescribed under Rule 27 of the Central Reserve Police Force, 1955. Petitioner, being a habitual deserter, in the proceedings, did not avail the opportunity granted to him. Neither he has submitted a written statement nor availed the opportunity of cross-examination though the evidence of witnesses was recorded in his presence.

The order of the Disciplinary Authority is well founded on the procedure. The same has been affirmed by the Appellate Authority as well as the Revisional Authority. None appears on behalf of the petitioner.

Patna High Court CWJC No.8800 of 1998(6) dt.05-07-2019 2/2 Writ petition is, therefore, dismissed, as not pressed without going into the merits of the submission advanced by the learned counsel for the Union of India.
