Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 376, 201 of the Indian Penal Code and Section 3⁄4 of the POCSO Act.

The FIR is against unknown. Name of the petitioner surfaced during investigation as main conspirator of the crime of rape and murder of a 10 years girl. In the statement recorded under Section 164 Cr.P.C., mother of the victim has also raised suspicion against the petitioner.

It appears that several accused persons have already been allowed bail by different Co-Ordinate Benches of this Court as well as by this Court. Petitioner is in custody since 19.01.2019. Investigation of the case is already complete. Learned counsel for the informant opposed the prayer

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Amnaur Police Station Case No. 41 of 2017, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/Banti U T
