The petitioners seek bail in Gangabridge P.S. Case No. 115/2018, instituted for the offence under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

In the written report, it is alleged that on the basis of confidential information, the police party reached at Terasiya More and stopped a tempo from which two persons started running away, who were apprehended by the police on chase. On search, 95.580 litres of Nepali liquor was recovered from the said tempo.

Learned counsel for the petitioners has submitted

Patna High Court Cr.Misc. No.55945 of 2018 (2) dt.26-09-2018 2/2 that petitioners have no concern with the aforesaid liquor. They were not sitting on the aforesaid tempo. Seizure-list is part of F.I.R., from which it appears that the recovery is not from personal possession of these petitioners.

The petitioners are in custody since 30.07.2018. Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Gangabridge P.S. Case No. 115/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
