The sole petitioner, who is in custody in connection with Basopatti P.S. Case No. 80 of 2014, G.R. No. 1301 of 2014 registered for the offence under Section 376, 323, 341/34 of the Indian Penal Code and subsequently Section 4 of the POCSO Act was added , has prayed for grant of bail. It was submitted by learned counsel for the petitioner that one of the co -accused has been granted bail. Besides hearing I have perused the material available on record. In the F.I.R. there is specific accusation against the petitioner. From the impugned order it is evident that during medical examination of the victim girl who was aged about eight

Patna High Court Cr.Misc. No.26715 of 2016 (2) dt.11-07-2016 2/2 years the allegation has been corroborated. It is not a fit case for grant of bail.

The petition stands dismissed.

Keeping in view the fact that petitioner is in custody while dismissing the prayer for bail it is desirable to observe that the court below may take appropriate steps so that the case may come to its logical end without unnecessary delay. (Rakesh Kumar, J) Praful/- U T
