JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The truck of the petitioner was robbed leading to lodging of the case by the driver Ram Parikshan Kumar. During investigation, Ram Parikshan suggested that actually the vehicle was not robbed but he lodged a false case on the instruction of this petitioner, thereafter the supervising officer suggested for converting the case under section 420 IPC against the petitioner. It is submitted by the learned counsel for the petitioner that the driver in order to grab money of the petitioner who is owner of the truck has changed his version. Statement has been

Considering the thrust of accusation against the driver of the truck who is the informant of the case, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Sono P.S. Case No.193 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
