This is second attempt for bail on behalf of the petitioner in connection with Nanpur PS Case No. 168 of 2019 registered for the offence under Section 307 of the IPC and Section 25 (1-B)a , 26 , 35, 27 of the Arms Act inasmuch as earlier bail application of the petitioner was rejected by order dated 15/06/2021 passed in Cr. Misc. No. 40439 of 2020 with liberty to him to renew his prayer for bail after nine months if the trial does not register any progress.
The allegation as per the First Information Report is that the petitioner fired upon the informant due to which he sustained fire arm injury on his chest.
Learned counsel for the petitioner submits that trial has not registered progress and the petitioner is in custody since
Patna High Court CR. MISC. No.19931 of 2022(3) dt.18-05-2022 2/2 30-08-2019.
This court vide its order dated 20/04/2022 has called for a report regarding the present stage of the trial and in pursuance thereof learned S.D.J.M. Purpri at Sitamarhi has furnished the report vide letter no. 113 / 2022 dated 30th April , 2022 and from perusal of the same it appears that seperated case record has been committed to the court of Sessions. Taking into consideration the observation of this Court , the fact that petitioner is in custody since 30.08.2019 and this is 2nd attempt for grant of bail, as such, I am inclined to grant regular bail to the petitioner after framing of charge. Let the petitioner, above named, be released on regular bail after framing of charge on furnishing bail bond of Rs. 25000/- ( twenty five thousand ) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri, Sitamarhi in connection with Nanpur PS Case No. 168 of 2019.
