JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 10-08-2016 Heard the counsel for the petitioner and the State. Apprehending his arrest in Bidupur P.S. Case No. 376 of 2014 registered under sections 420,467, 468 and 120B/34 IPC, the petitioner prays for anticipatory bail.
According to the prosecution case, the informant purchased a piece of land on 09.09.2014. It is alleged that accused nos. 1 and 2 again sold the said land in favour of accused nos.3 to 9 on 21.10.2014 for which non judicial stamp papers were purchased from the petitioner who, at the relevant time, was running the stamp vending shop/kiosk.
It is stated that considering the dispute with respect to the title of the land subsequent purchaser(s) of the land have already been granted anticipatory bail by the learned Sessions Judge. The
Patna High Court Cr.Misc. No.31008 of 2016 (2) dt.10-08-2016 2/2 petitioner is stated to have only sold the stamp papers. Considering the facts and circumstances of the case, let the petitioner, named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Vaishali in Bidupur P.S. Case No. 376 of 2014 on condition that one of the bailors shall be his own/ close family member. He shall appear in person on each date fixed at the trial. In case he skips the appearance without any compelling reason on two days consecutively, the trial court shall be at liberty to cancel his bail bonds. (Kishore Kumar Mandal, J) HR/- U T
