JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-09-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Mashrak P. S. Case No.250 of 2018 registered under Sections 341, 323, 324, 307, 379 and 504 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that specific allegation of assault by Daab is against Ritebh which caused only simple injury. So far as the petitioners are concerned, petitioner no. 1 is an order giver and petitioner no. 2 is alleged to have taken away Rs.10,000/- from

Patna High Court Cr.Misc. No.55671 of 2018 (2) dt.20-09-2018 2/2 the pocket of Abhishek. It is further contended that there is counter case and petitioners' side also sustained injury. However, the informant of the case has not explained as to how the accused persons sustained injury.

Learned Additional Public Prosecutor for the State opposed the prayer for grant of pre-arrest bail to the petitioners. Having considered the rival submissions and the allegations made in the FIR, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Saran at Chapra in Mashrak P. S. Case No. 250 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
