Petitioner is seeking anticipatory bail in connection with Hathua P.S. Case No. 11 of 2019 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that nothing has been recovered from the residential house of this petitioner and the allegation that recovery has been made in Bathan which does not belong to this petitioner and there is no material to connect the petitioner with the present case. It is submitted that petitioner has no criminal antecedent. Learned APP for the State is present and has opposed the prayer for bail.

No.18320 of 2019(2) dt.04-04-2019 2/2 Considering the facts and circumstances of the case wherein it is submitted that nothing has been recovered from the residential house of this petitioner and the allegation that recovery has been made in Bathan which does not belong to this petitioner and there is no material to connect the petitioner with the present case as also that he has no criminal antecedent, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Excise, Gopalganj in connection with Hathua P.S. Case No. 11 of 2019, subject to the condition prescribed under Section 438(2) of the Cr.P.C.
