JUSTICE SHIVAJI PANDEY ORAL ORDER 18-09-2020 Heard learned counsel for the petitioner and learned APP for the State through Virtual Court Proceeding. In this case, the petitioner is seeking regular bail in connection with Ramgarhwa P.S. Case No. 25 of 2019, registered for the offence under Sections 363 and 365 of the Indian Penal Code.

Earlier, the petitioner had moved before this Court for bail in Criminal Miscellaneous No.34322 of 2019 and a coordinate Bench of this Court vide order dated 17.08.2019 rejected the prayer of the petitioner for bail. The order is well reasoned order quoting different paragraphs of the case diary. This Court had called for the status report and from where it appears that the case has been fixed for evidence.

Patna High Court CR. MISC. No.17475 of 2020(4) dt.18-09-2020 2/2 Learned counsel for the informant submits that the informant is ready to co-operate in early adjudication of the case.

This Court vide order dated 13.07.2020 had directed the Superintendent of Police, East Champaran at Motihari, to produce all the witnesses so that the trial may be concluded but, looking to the present pandemic, most probably it is very difficult to produce the witnesses. Now, the normalcy is being restored gradually hence, this Court directs the Superintendent of Police to produce all witnesses before the Court below and on being produced, the Court below will proceed with the trial and try to conclude the same within one year from the date of receipt/production of a copy of this order. Accordingly, the prayer of the petitioner for bail is hereby rejected.
