JUSTICE ARUN KUMAR ORAL ORDER 06-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Saharsa Sadar PS Case No. 487 of 2017 Special Pocso Case No. 20 of 2017 registered under Sections 9, 10 and 11 of Child Marriage Prohibition Act, Sections 16, 17, 18 of the Pocso Act and Section 376 of the IPC. The allegation in brief is that two minor girls were married with the petitioner and one another on paying twenty thousand rupees cash to parents of the girls.

Learned Counsel for the petitioner submits that the family members of the informant wishfully got the girl married with the petitioner but in the medical report no sign of rape was found and the petitioner is in custody since 19.5.2017, however, charge-sheet has been submitted in this case.

Having considered the said facts and circumstances, the petitioner, namely, Balbir Singh @ Balvir Singh @ Balvir is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I -cum- Special Judge Saharsa in connection with Saharsa Sadar PS Case No. 487 of 2017 Special Pocso Case No. 20 of 2017.
