The petitioner seeks bail in connection with Suryagarha P.S. Case No. 98 of 2016 dated 17.05.2016 instituted for the offences under Sections 304B, 201/34 of the Indian Penal Code.

The petitioner is husband of the deceased. The father of the deceased, who is the informant of this case has alleged that the deceased was being pressurized for bringing rupees five lacs as additional dowry. Non fulfillment of the same led to the physical and mental torture of the deceased and ultimately the deceased was set on fire. The small child in the lap of the deceased also has died because of the burn injuries. Mr. Ajay Kumar Thakur, learned counsel for

No.56813 of 2017 (3) dt.12-01-2018 2/2 the petitioner has submitted that though the family members of the deceased have supported the prosecution version but some independent persons have stated that the deceased committed suicide because of her not getting along well with her husband and in-laws.

The charges have already been framed in this case and the petitioner is in custody since 23.01.2017. Considering the nature of allegation against the petitioner and his relationship with the deceased, this Court is not inclined to grant bail to him.

It is expected that the trial would be concluded expeditiously.

The prayer for bail of the petitioner is rejected with the aforesaid observation.
