The sole petitioner, who is in custody since 27.05.2016 in Barabar Paryatan P.S. Case No.23/2016 registered for the offence under Sections 147, 148, 149, 323, 341, 435, 307, 386 of the Indian Penal Code, Section 27 of the Arms Act, Section 17 of the C.L.A. Act and Sections 16, 17, 18, 18(A), 20 of the U.A.P. Act, 1967, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that though in the F.I.R. the petitioner was named as accused, there is no specific accusation against the petitioner. He submits that the petitioner has falsely been implicated in the case.

Patna High Court Cr.Misc. No.32213 of 2016 (2) dt.19-08-2016 2/2 However, learned Addl. Public Prosecutor submits that the petitioner is having criminal antecedent and like the present case, he is accused in other case also. This fact has been mentioned in paragraph-3 of the petition.

Keeping in view the nature of accusation as well as antecedent of the petitioner, I am not inclined to extend the privilege of bail to the petitioner. The petition stands dismissed. (Rakesh Kumar, J) NKS/- U T
