The petitioner seeks bail in Special case No. 77 of 2018 arising out of NTPC P.S. case No. 25 of 2018 registered under Section 354, 354(d), 447 of the Indian Penal Code and under Section 8 of the POCSO Act.

The gist of the allegation is that while the prosecutrix was all alone in her house the petitioner entered into her house with an intention to outrage her modesty but on alarm the petitioner fled away.

The learned counsel for the petitioner submits that petitioner is neighbour of the informant and on account of some petty dispute the petitioner has falsely been implicated in the case and for that petitioner is in custody since 30.04.2018. The

Patna High Court Cr.Misc. No.58696 of 2018 (2) dt.20-09-2018 2/2 petitioner has already remained in jail for about five months. Considering the facts aforesaid and the period of incarceration of the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judgecum-Special Judge , POCSO, Patna in connection with Special case No. 77 of 2018 arising out of NTPC P.S. case No. 25 of 2018.
