The petitioner is in custody in connection with Trial No. 2455 of 2018 arising out of Mainatand P.S. Case No. 108 of 2016 for the offences under Sections 188, 382/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 13.01.2019. He further submits that allegation against this petitioner is that despite the order passed in C.W.J.C. No. 426 of 2015, petitioner and others were involved in loots of ripe paddy crops. He further submits that petitioner is said to be a Member of Naxal group and that is why he has been made accused in this case.

Considering the fact that similarly circumstanced other five accused persons have been granted bail, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned SubDivisional Judicial Magistrate, Bettiah, West Champaran in connection with Trial No. 2455 of 2018 arising out of Mainatand P.S. Case No. 108 of 2016.
