Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 and 302 of the Indian Penal Code as well as 27 of the Arms Act. Though petitioner fired, however, no injury was caused to anyone, rather injury was caused by assault with bricks etc by other co-accused which caused death of the victim. Learned counsel for the informant opposed the prayer for bail on the ground of criminal antecedents of the petitioner.

The petitioner is in custody since 09.01.2018. Submission is that the deceased was himself accused in so many cases mentioned in para 9 of the petition. Considering the nature of allegation, let the petitioner,

Patna High Court Cr.Misc. No.57473 of 2018(2) dt.20-09-2018 2/2 above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sasaram (Town) Police Station Case No.1900 of 2017, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
