Petitioner apprehends his arrest in a case registered for the offence punishable under Section 366(A) of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in the confessional statement of co-accused, Prakash Yadav, who has already been granted anticipatory bail by the court below. Petitioner is none else than co-villager of co-accused, Prakash Yadav. Petitioner claims clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail bail.

Considering the facts of the case and clean antecedent

Patna High Court CR. MISC. No.29190 of 2021(6) dt.20-06-2022 2/2 of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Agiaon Bazar PS case No.13/2020, subject to conditions laid down u/s 438(2) of the Cr.
