1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 303(2), 352 and 351(2) of BNS, 2023.

3. Learned counsel for the petitioners submits that

No.18761 of 2025(3) dt.15-05-2025 2/3 petitioners are persons with clean antecedent and the informant alleges that his younger brother Raju was going to Bettiah for purchasing articles for his electric shop when he was intercepted by accused persons namely Shrawan and Dablu on account of previous enmity and they wrapped towel around his neck and started strangulating, thereafter Shrawan took Rs. 90,000/- from his brother's pocket which he was carrying, thereafter his brother informed him and the informant asked him to come back, next alleges that in the evening, the accused persons came and Pradeep assaulted him by an iron rod causing injury on head while Shrawan assaulted by lathi on his left hand causing injury and Babloo threatened to kill the entire family.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that petitioner and the informant are neighbours and are having dispute relating to drainage and as such an altercation took place in which both sides assaulted each other and from side of the petitioners also Balthar P.S. Case No. 120 of 2024 came to be instituted against the side of the informant and others and as such, the instant FIR is a counterblast. It is further submitted that even injury suffered by the injured is simple in nature and the blow was not repeated.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Balthar P.S. Case No. 121 of 2024 subject to the conditions as laid down under Section 482(2) of the BNSS.
