JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-07-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 11.03.2016 in a case registered for the offences punishable under sections 498A, 406 of the IPC and under Sections 3⁄4 of Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands.
It appears that the petitioner was granted anticipatory bail by a co-ordinate bench of this court in Cr. Misc. No. 21467 of 2014 with certain conditions but the petitioner failed to comply with those conditions and his bail bonds were cancelled. It is submitted by learned counsel for the petitioner that investigation has already been concluded and the trial has
Patna High Court Cr.Misc. No.28432 of 2016 (2) dt.12-07-2016 2/2 commenced. The petitioner undertakes to appear regularly in the trial.
Considering the nature of accusation and stage of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 68 of 2014, Tr. No. 2937 of 2016. Learned court below shall be at liberty to cancel the bail bonds of the petitioner if the petitioner defaults without any reasonable cause on three consecutive occasions.
