ANJANA MISHRA ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Barun P.S. Case No.118 of 2018 for allegedly having committed the offence under Sections 379, 411, 420 and 34 of the Indian Penal Code and Section 4/40 (BMMCR) Bihar Minor Mineral Concession Rules,1972 and Section 15 of the Environment Protection Act, 1986. Learned counsel for the petitioner submits that the petitioner is the Driver of the tractor, which is alleged to have been carrying sand. It is further submitted that being the Driver of the vehicle, he has nothing to do with the sand theft nor he violated the provisions of the Bihar Minor Mineral Concession Rules,1972 and the Environment Protection Act,

Patna High Court Cr.Misc. No.65996 of 2018(2) dt.19-12-2018 2/2 1986 as has been alleged. It is thus submitted that the petitioner may be extended the privilege of anticipatory bail. Considering the aforementioned facts and circumstances and that the petitioner is having no criminal antecedents,let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No.118 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
