Petitioner seeks bail in Excise Case No.321 of 2018 instituted for the offence under Section(s) 30(a) of the Bihar Wine Prohibition and Excise Act, 2016.

In the written report, it is alleged that police recovered total 210 litres Nepali Saufi from the jute bag. It is alleged that this petitioner was chased and apprehended. From the written report itself, it appears that there was no recovery from conscious possession of the petitioner.

Petitioner is said to be in custody since 14.07.2018 having clean antecedents.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Motihari, in connection with Excise Case No.321 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
