JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although it is stated that petitioner was caught along with others while they had assembled to make preparation for committing dacoity but according to the prosecution case itself, nothing has been recovered from conscious possession of the petitioner though some firearms are said to have been recovered from possession of other accused. Petitioner does not have any criminal antecedent.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati ( Gaya) in connection with
